If you have acquired rights to real estate in Mexico that border with federal zone (FZ) or land gained to the sea (LGS), you would be certainly interested in acquiring the rights to exclusively use and enjoy such areas. The rights to exclusively use and enjoy the FZ and LGS are granted by the federal Mexican government in favor of individuals or entities by means of permits, concessions and authorizations subject to a specific authorized use and limited currency, which may be renewed or extended.

The federal zone in general terms is defined as the fraction of land, – usually 20 meters wide and with an inclination not exceeding the 30°-, bordering beaches, rivers, lakes, lagoons, estuaries, and natural marine water deposits which directly or indirectly communicate with the sea or marinas; and inclusive the fraction of land bordering roads.

The LGS are generally defined as the fraction of land created (gained) by natural events or human actions and that is located between the maritime federal zone and the adjacent private properties.

In order to determine the existence, accurate localization and dimensions of the FZ and LGS in any Mexican territory, both the legal and technical assistance of specialized professionals who have the experience and profound knowledge of the legislation and official methodology to survey such areas, is required.

Both the FZ and LGS are public or national property, and for that reason their ownership can not be transferred to private owners, nor be subject to prescription or embargo. However, there are processes available to convert the LGS into private property and to transfer them to private owners under certain restrictions.
